    Team,

    Just today I received a email from TX CIS.....saying......

    The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.

    PD: 01/29/07
    485 Filling: 07/12/07
    Receipt Date: 08/17/07

    Got EAD, AP approved. Just last week I did my finger prints.....


    I don't where I am and what would happend to my case....I am planning to change my job using AC21...is that going to impact anything to my processing????

    What do you thing about the time frame for my case based on my PD????

    Guru's please advice....as I am planning to chnage my job in March or April/08.....

    I have an MS degree, so IF the SKIL is passed, my PD will become current.
    My understanding of SKILL for US MS is that it will not be counted against the cap. I don't see it saying that PD does not matter for US MS. What am I missing? Thanks.

    I think , of what Mr. Logic Life said summarizes and represents the state of us all , who wish to obtain a Green Card and are on H, L ect. VISAS.

    I think, It is absolutely right "We deserve fair and speedy immigration.".

    Opportunity of working in America is great ... but when skilled professionals will have to choose H1,L1 or GC , they land in an unpleasant experience, that goes on for ever until they obtain their GC.

    I am sure this is going to happen within this week or next week.

    1. They are going to take the revised visa bulletin and flip flop out from the website.
    2. They will accept application as Visa Bulletin said on Jun 9th.
    3. Because of this mess, they are going to give grace period till Aug 2007 for filing.

    And in addition they will say that they will keep it in the backlog and when Visa number gets available they will process.

    Why are you so PROUD to be an American? Just be happy for it...its just your need so that you can live in this country for as many year as you want and of course its good achievement and i am happy for you, you just lived here for 10+ yrs and you forgot your Home country where you were born and gave you a good education with you had an opportunity to come here and make your life based on that..you should be PROUD of that country no matter where you go and what you achieve its all because of you Home Country

    If you are form INDIA then you should say "Mera Barath Mahan" first and then "God Bless America"

    Why shouldn't he be proud? I am sure he had to struggle to get his GC first as we all did and then wait to become a US citizen. He has chosen the US to be his country and so he has all the reasons to be proud! As for being Indian fisrt and then being American, it is all wrong. You can't have one foot in one place and the other foot in another place. He chose the US as his country and he as an obligation to be loyal to the US first.

    Not a single post to counter kumar1's argument!!! I wonder where the interfiling opponent MS/PHDs are gone!:confused:

    My post is going to make few MS/Phd people angry over here. Correct me if I am wrong, but when you came here to do MS/Phd, you came on a student visa...Right? Student visa comes under Non Permanent Non Resident alien category. All of you had a burden to prove to the US consulate that after you complete your degree, you would go back to your home country. All of you prepared for that and you knew the moment you said, I might not come back, F1 would be gone! You said this...every time you went back for F1 visa revalidation. Mind you..that H1/H4 never had that burden. They could have easily said that yes, if I like USA, I might not come back.
    Now fast forward....MS/Phd is done. Suddenly...."I will go home after MS/Phd" statement is gone..and hunt for H1-B is on! Once they get H1-B, hunt for Green Card starts. Once this heavy head Phd guy, who spent last 5 years on 1500 bucks a month is in GC line....he also realizes that hey, H1-Bs should not be allowed to interfile. After all, they all work for desi consulting companies. Yeah..right! Look who is talking! All H1s should come in EB-3, after all they did not go through 1500 bucks a month for 5 years.
    Here comes a Phd guy who always lied to the system saying "I love my home country, my research would do wonders to the society at home" is not leaving any stone unturned to get his GC (faster than anyone else).....tell me, who is inferior? A Phd student who lied to the system for 4/5 years and suddenly changed his intent or an H1-B candidate who never had the burden to prove that he would go back.

    All of us are part of this very painful journey! I have spent 8 years on H1-B and I am still waiting for my GC. I work for a desi consulting company, my GC is in EB-3, I have a B.Tech. degree from IIT and I am sick and tired of this GC mess.

    Does USCIS send RFE for both primary & dependent applications, if it is related to Employment?

    Gurus, any advise.

    If I understood your question right, are u asking about EVL RFE for both primary and dependent applicants?

    I Don't think so. Logically even when the dependent works,the primary applicant's employer need to prove that they support GC process on that application.

    They will not check for dependent EVL as it is not relevant in this case.
    At the most they may verify dependent past non-immigrant visa status.

    Wonderful with BOA!!! but always looked bitter due to high wire transfer fee.

    4-9 years ago, when used to send large amounts ($4000, my family was in India), I used BOA because I had bank account with them. They would charge me US$45 per transaction. Seeing that others are charging $10 or so, I reached Manager about such descripency. He explained that after taking $45, BOA becomes my representative and works in my best interest. He showed that last conversion rate was $1.50 more than any bank published rates in India on that date. So I made effectively $40-50 even after paying us $45. BOA manager explained that they gave Times Bank Indian Rupee. Had they given US$, Times Bank would have eaten all the profits.

    With others money transfer agencies:
    #1. I always got approx. $1 less than published rates.
    #2. There has been delays
    #3. They have deleberately taken more number of days to do transaction on that day, when rates were worst.

    I never lost money by sending through BOA, it used to be $4000-5000. But since BOA charges $45, I could not use their services for money less than $2000.

    $45 had made trustworthy partner, free/$3/$5/$10 made stealing partners.

    We attached fees to the visas that now bring in millions of dollars. These fees and the dollars that come with it are invested in training grants to educate our own workforce. We use the funds to put kids through school for science, technology, engineering, and math skills. We provide students with scholarships with the hope that they will replace imported foreign workers.
    A part of H-1B fee paid by H-1B worker is to replace himself/herself. How nobel!

    put they didnt file
    when i ask for refund, they say there are holding money till oct 2007
    I checked with my friends, their law firm are also holding money till date become current again

    why give them free loan for months???

    There are literally hundreds of thousands of people from India and China ready to take your or my place if we go back. This is even if you tell them they will be stuck with the same employer and job profile for years, and no hope of a GC for the next 7 years. The lure of the US is still big. Reverse-brain-drain threat is unlikely to work...

    In reality, many companies who have subsidiaries abroad can use L1 visa program. But H1B offers flexibility that is much desired by many companies. (It is very less abused compared to H1B). No numerical cap on L1B may not go well with many of us. But I am very +ve that the visas are not issued in anticipatory mode like H1B. And why do companies spend 5K if they do not want to get the worker here? Do they like waste money just like that?

    Logically this highlights the real problem in the system - numerical caps. If the caps are not there and companies can get a visa-on demand, they will not spend 5K per visa on anticipatory mode. Because there is no need to do that.

    So no system is perfect. We have to minimize abuse and act responsibly when it comes to sensitive issues like immigration...

    As per the current 'rules' EB1, EB2, EB3 are given EQUAL preference .... countrywise

    My guess is that EB3 has more people in line - for the same reason that there are more people with Bachelors than those with PhDs.

    If only USCIS/DHS give an accurate(!) number of apps in each category ... then we can make some informed decision instead of hoping for something like Jul 07.

    Depending on what line we are in - we want that to move not slower (than others). And one of the fundamental concepts in queueing theory is that " as the system gets congested, servicing delay increases"

    Like i read in friedman's book ... paraphrased - "If someone lost a job - the um-employment rate is not 5% or 10% - it is 100%"

    H1b_Alex,

    It looks like your post has met with resentment on the forum. Let's look at it openly and see if you have a case here.

    1. The company gave you the i-797 to come the the USA which means they applied for you with USCIS.
    2. They said they had a job for you. USCIS checked with DOL and agreed and approved the application. At this point you are their probatory employee.
    3. Do you have any documentation (on legal letter head) showing the the company (employer) asked you to report to work on a certain day? If yes, positive!
    4. You said you paid H1B fees. How did you do that from your home country? This is a negative since you broke the law.
    5. You land here, assuming on a good estimated date based on when you were asked to report for work. Now, the employer (company) does not have a job for you. This is totally fine in the eyes of USCIS/DOL and US Law.
    6. The only responsibility of the employer is to now to pay for the cheapest air fare (if air required) to send you back to your country.

    Ofcourse, filing a lawsuit can be done even if you are not here but being here obviously helps A LOT when fighting such a case. However, chances of quick resolve=30%. Chances that you will win= 20%

    The reasons are simple and outlined above. Sorry but your chances are slim. :(



    Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
    however after coming here , Paid for my own ticket and landed here on start of january 2011.

    Confirmed my arrival to the employer too. Since my leaving the home country there has not been any mail correspondence from the employer , though i have been writing many. Talked to him over the phone and he said he wasn't responsible for my arrival as he doesn't have any project for me. Waited to get another job as a H1B TXFR but stuck with trnsfrs issues due to non availablity of paystubs from him.

    I never reported to work as he said dont come to office, dont have any paystubs, but have all my H1B papers , I97 and Employment offer from that consultant. I have decided to leave back to my home country but not before reporting this blood sucker to DOL.

    I need to clarify a few things before i nail these blood suckers

    1. How long before i board my flight back home , should i send the documents to DOL

    2. I have the originals of H1B filing and LCA and I94, are they rquired in originals
    or copy to send to DOL

    3. What other documents should i send alongwith

    4. Do you think my case will get weaker if iam not here ? As i am flying back to my home country.

    5. I dont want these suckers to go scott free, so how to build my case here , can i ask the DOL to recover my wages for 4 months i wasnt getting paid.


    I do not care if i get any wages or not from them , but i really wanna see the locks on the gates of this company. They shouldn't take H1B and its applicant for scapegoats.

    Any advices are welcome to help me bring these guys to justice.
