shishya and spdy_mn, the point here is when did you get married. As long as your marriage date is before the approval date you are fine. In fact, I remember reading in murthy's website that even if you find out that your 485 has been approved right after you got married (all petitions will have an approval date), you are still eligible to file for your spouse's 485. I think INS has a 180 day window to consider the spouse's application. I guess you have to prove that you got married before the approval date of your 485. Search the murthy website about this posting from her. Good luck.

There is vast difference between US and Indian housing market crash. India RE market will not collapse like here. There may be a melt down or small correction. The simple big reason is demand for housing in middle class due to economic growth. Based on population density, US is 9 times bigger than India. Lot of land in US. But housing land is so limited in India. So there is always demand. Second reason, there is no sub-prime lending in India. Third, in India, housing loan is based on cash worthiness rather than credit worthyness like in US. So we may not see such a massive foreclosure/bankrupcy in India to bring the price down considerably like in US.
However, now the prices or extremly high, such that it can not be affordabe to people other than NRI or IT folks. 1 crore houses are very common now. Based on US economy it will definitly come down. It will be depend on how hard IT/outsourcing bussiness gets affectd in future.

You are saying new OBAMA govt. in many of your postings. Are you his election agent?. This forum is not for any party affiliations. Election is yet to start. Democratic party is not officially announced their candidate. All powerful President Bush is tried hard to help immigrants. Then how come a weak person who is still fighting for a ticket can take left and right congress and senete veterans.!!!!!!
Due to the lot of noice we have done,most of the law makers know theres a community called legal immigrants, and their long waiting periods due to the outdated rules. The new OBAMA government's agenda is to take the immigration reform during his first year tenure in the ffice. Once the immigration reform took place, I am pretty sure there would be significat changes in employment based category, which drastically decrease the backlogs in all EB categories.
In addtion to that "legals are first than illegals"- OBAMA. This itself is enough for clearing off all the backlogs.

hightech workers and eventually it results to a exodus i'm sure they will realize the mistake at the end.
When they will see that No one is interested in this country to study and Pursue STEM ( even with scholarship) and their problem is still unresolved they probably have to spend Double the Money to bringback Indians here.

I didn't meant to hurt feelings here. and i know how Canada is less opportunity for IT folks. but just couple more points.
1) if number of jobs was criterion, India has far higher number of jobs in IT then US, so people should be rushing bk to India which is not the case. I don't think number of Jobs available in US is why people wanna live here. Even if it takes year or a little more, at least Canadians are transparent about the process.
2) I know everyone here is well read and well educated. Read up about AUS, NZ, Canada and few other countries which have point bases system, they are not under developed or backward in any way. Wikipedia might help.
And please read carefully, my wife is on another beauty of a status called H4B, i mentioned clearly i know how easily people got their H1B's through consultants.

On Aug 11, 2007 - I 140 Denied Due to Ability To Pay issues
Description for denial ( I have also attached the denial notice)->
They looked at years 2003 to 2006 history for I140 since PD is JAN 03.
* Reason 1 - Lower salary than specified in labor
Preferred Wage in labor - 78,750
W2(2003) - $76,850; W2(2004) - $75,638; W2(2005) - $31,652;
W2 for 2005 is less due to company merger. I have another W2 from new company for 2005. I moved to another company due to merger but lawyer continued GC throgh old employer since the both companies exists after the merger.
* Reason 2 - negative net income of the petitioner
2003 (-$537,841); 2004(-$445,493); 2005(-$527,298); 2006(Not Submitted);
* Reason 3 - 2003 and 2004 OK but net current assets are -ve in 2005
and my lawyer did not provide 2006 information

2003 $4,272,733 $3,789,359 $483,374

It's deplorable that most attorney's don't educate small employers on meeting ability to pay even before filing the Labor Certification.
I would suggest that you appeal the case with supporting statements from a good CPA and in the meantime go for a fresh labor certification.

What I am trying to say is that whether GC takes 1 years or 5years, it is worth the wait IMHO. If I have to do all over again knowing it could take 5-6 years, I will do it. But that's just my personal opinion.

I know what you are getting at when suggesting that we should be open about our needs and goals .... ICICI can not predict rather no one can predict what will be the exchange rate tomorrow. The minimum forex transaction at dealer level is for $1 mil. So, they can't promise you some rate the moment you hit the submit button. They will pool all the transactions like yours and then do a big contract together. ICICI provides lot of other services which SBI will not in terms of convenience. And ICICI deals big time in forex transactions. In this market the guy with biggest transactions will have lowest cost and depending on competition will have incentive to pass it on to you as an end user. They might time it within a particular time frame but that is something unavoidable.
Why cannot they just say it?. Why can�t they say that it will take 2 days to 22 days or 222 days to transfer the amount?, if someone needs to send money due to an emergency, they do it thinking that the money will be transferred in two or three days, a week maybe�

I suggest that you remove the glass house proverb. It makes the letter look a little unprofessional. Your letter without it is already very effective. Also put the "H1-B workers are illegal" quote (if there was such statement made on his show) at the top while you put across your objection. If such statement wasn't made but implied by the guest on CNN, don't put that in quotes.

As far as the "glass house" goes I can't change the petition even if it has one signature. I wrote this to create maximum impact and we can only hope that it does.

1. DO NOT talk to the party or attorney who sued you directly. If they call take the contact info, tell that ur attorney will call them.
2. Talk to your insurance company
3. Talk to an attorney
4. Gather all documentation that you have
Sorry about wat happened to you. Looks like there are considerable injuries . You might not win the case since you are at 80% fault. Like others said you can not go back to India like nothing happened. You have to consult an attorney, ask if he can work on contigency basis. They will get all med records to decide if other party is faking or claiming too much. If you loose the case, then it depends howmuch you have to pay. If damages awarded are less than 500K, you can file bankrupcy. But you end up paying like mortgage forever. Once you file bankrupcy, I think you can leave the contry legally. If you loose and wish to stay, Your payments will be reduced if you have kids and a house payment.

I heard that it needs to be at least 21 months to be able to win the law sue...and suing them might not work anymore when my pending time is qualified.
If someone else with similar names/same birthdays commited a crime, why do we need to suffer as a possibly "HIT"?
If I were to wait for 4 years for Name Check, I rather be the person commiting the crime so they can reject my I485 instantly.

I would strongly disagree that H1 = cheap labor. It's only the H1B employer who pays low salaries, where as the client pays the same billing rate to all contractors (including US citizens).
I agree with you. I was just using those salary numbers as an example. Did not mean to imply that H1 indicates cheaper labor.

They don't even know the whole story. Yes, all those years I had to lie, especially to my parents:I didn't want them to worry about me.
I was always saying: "I am fine, just fine.."
I am waiting for my friends and family to ask me the usual question:
"So, how come you don't have your GC yet? What are you doing?"
Then, I will have something to show them!
