Best thing to do is stay here till your visa extension is due,and apply for extension from here,you will get new 194 with your extension if its approved.
hope they dont notice it,usually they dont..but take attorney advice.

In the very fisrt line of the AILA document it says that the counting is still on
From the AILA Doc:
USCIS can now announce that the cap of 20,000 on these exempt cases remains open and that
USCIS will continue to monitor these filings.
That means - US-MS petitions on and before APril 9 are safe and USCIS is still accepting US-MS applications

there were a lot of instances when people do not even know about the visa bulletin even thought they have applied for it a long time ago. especially when they are full time employees well taken care of by their companies. for those gc is just another entity.
having said that, that should not be a reason to get into trouble in future. will it effect him in the future or not and if so how is something that he should research with an attorney and make a conscious choice for himself.
on the contrary this is just another incident by USCIS to prove how big time a**h013$ they are. seriously idiots. how come they manage to do such stupid stuff. what can IV do to counter such issues. this is a serious problem and this could jeopordize some one for a mistake from uscis. as a software engg or a mech a engg or a doctor, we as customers should be doing minimal stuff from immigration side. we have better things to take care of. not a useful post but just venting out. sorry guys.

Of course he is very informative, however he is very biased and having wrong openion that EB3 India has stolen EB3_ROW number in previous years as he belongs to ROW. He wrongly assumes that till EB3-ROW becomes current EB2 & EB3-India will not see any movement. He thinks no one knows the rules, laws ect..and he is only one knows everything. The actual fact is most peoples have been doing research on retrogression like him last two years and not having enough time to reply his post. To fuel his openion DOS is violating the section 202 of INA and no one cares about this including IV core team.

You should consider gathering a few more EB2 India guys and have a crack at suing USCIS for violating the law...Unfortunately I am EB3 India and this suing does not help me...
You can ask for GCs for all members of your law suits...But USCIS would fight you hard for sure...
IV is collective organization...IV's solution would be to get numbers increased for everyone...Otherwise we would again have a fight bet EB2 and EB3 link the one we had between guys who want the 485 without PD and those who oppose it...

Is IV only for those who have filed I485?
I gave my opinion and people gave me lot of reds. There is a majority here who already have EAD and have filed I485. You people do not care for those who are less fortunate and struggling in the early stages of the process. If July 07 had not happened, all of you would be asking for I485 filing option today.
By giving reds to people who disagree you will drive people away and make IV only for those who have filed I485 and not for the entire EB immigration people.

2. When IO reviewed your case, did they look at your physical I-485 file? Did the service center transfer your case to the USCIS office you went for the interview?

First of all hiring someone on tourist visa was illegal, You had not thought about the safety of your child while doing it and without proper background check or reference checks hiring someone for nanny or anything like that involving children can be risky. There are instances of abuse which certainly will go un noticed.
From a legal perspective, Did u have a written contract for nanny, even if you sue the person you might not be able to recover anything and hiring an illegal may land you in trouble.

Understood dude, but the fact, Iam not questioning anyone's contributions here. Please understand one thing, I did not even question other members in this forum. It all started when i asked Admin2, What post accused admins in the "If i could be little blunt" thread. I did not even utter a single word or question him ? If you want you can ask Admin2. It is only after he said MadhuVJ and GCStatus are the same. I started this argument. Because to me, it was rubbish. Eversince, Iam only trying to clear this thing up. Even after that, I did not bad mouth him. Iam giving all my details just to make it clear to him that Iam not GCStatus. Hope you got my point. Infact, if you want to go to page 3 and start reading all my posts. Tell me, If i crossed my line in any of my posts.

Who would have been benefitted? YOU and ME and NOT Admin2.
There are already several threads with EB3/EB2. All of us have our own day time jobs. Let us knot focus on fighting among ourselves. Let us not even fight with USCIS. What we want is that lawmakers and USCIS should understand our problems and make them realize that US will benefit by giving us GC's and not vice versa.
In the past 2 years, I have just 50 postings. All of them are either confirming calls to law makers or contributions. This I am writing to plead you stop these fightings. We have had enough in the past 2 years.

Dearest Sugaur, you raised a very valid point. Dont be disheartened by the bashing you are recieving. I can asure you that there are atleast a "few people like you" out there. Otherwise the world would be heaven, right? If only the rest of us were careful to allow such people to freely express their opinions. As somebody said "when you squeeze something, what comes out was what was inside". Squeezing orange will not produce apple juice. Just read your response and you will realize what is inside you.
