We have just been told by reliable sources that the bill is being sent back to the Senate Judiciary committee where Frist and Specter will rework the language of the bill, starting April 24th.
All reasonable amendments will be worked into the bill text itself. Our amendments have a lot of support and the intent is to include them into the text of the bill.
So we need contributions going forward to get our requirements into the base text, and to protect them in conference with the House.

The following are clear cut abuses.
I want to give some fraud and abuse examples. Unfortunately, there are some bad apples in the H-1B visa program.
In 2005, a man was charged with fraud and misuse of visas, money laundering, and mail fraud for his participation in a multistate scam to smuggle Indian and Pakistani nationals into the United States with fraudulently obtained H-1B visas. The man created fictitious companies, often renting only a cubicle simply to have a mailing address. He fabricated tax returns and submitted over 1,000 false visa petitions.
Another man pled guilty last August to charges of fraud and conspiracy. This man and an attorney charged foreign nationals thousands of dollars to fraudulently obtain H-1B visas. He provided false documents to substantiate their H-1B petitions.
Also, an Indian outsourcing company was fined by DOL for paying lower wages. Another example of clear cut fraud.
I am also anxiously awaiting this report.
The U.S. Citizenship and Immigration Service is also worried about fraud in the program. This agency's investigative arm, that subdivision called the Fraud Detection and National Security unit, is doing a fraud assessment of the H-1B and L visa programs. I asked the unit to brief my staff on their work, and they reported they are not finished with analyzing the data. Senator Collins of Maine and I put the agency on notice that we are anxiously awaiting this report so we may continue our quest to reform the program appropriately.
The questions are
What is a fraud?
How will yo detect a fraud?
How many companies are commiting fraud?
How many workers are involved in fraud?
Remember, they are not interested in benefit for worker. That is, something that is a problem for worker (kind of issues mentioned in this thread) are not of interest to them.

EAD & AP is luxury & aggressive. Keeping H1B active is being conservative and playing with probability and backup. It depends on your nature. Go for it!!
If you are planning on a big investment like buying a home or something like that. It is better to stay on H1B so you have a backup if something goes wrong with GC.
I have seen problems with cases using AC21 when they apply it asking for more details and also sometimes ur I-140 is revoked by your sponsoring employer and USCIS may trigger a NOID for you. Ofcoourse you can file MTR and prove that them that it is legitimate to change jobs using AC21, but if you have H1B also then you have a peace of mind.
Also for the first job change use AC21 and do H1B transfer also(just being cautious) and wait for 6 months so that USCIS is already aware that you ve changed company. You can address any RFE/NOID during this period. But later on you can be on ur own.

Some applications received on the first business day were returned, but all applications since then are being held and not returned. One can speculate on the reason, of course. Possibly USCIS is preparing for a loss in litigation. Possibly they are preparing to cave sooner. Let the speculation begin....

As the President of the United States how do you intend to address the problems faced by future Americans already living and working LEGALLY in the United States? Anand, there is a conference call scheduled this Friday. Pls join the conference call and pour in your ideas. Sure if your ideas are good and conceivable Core team would defly work on implementing it. Dont be an outsider, try to get more involved. Again if you want to be part of the Core Let Aman & Co know, they should be able to delegate you some responsibilites.
Just like you, everybody is frustrated with the lack of progress. But we do understand our limitations, we can only educate the lawmakers with our issues, but we cant arm twist them to do something favorable. We have to keep our expectations right. As Logiclife told if big corporations like Microsoft cant achieve what they, want who are we? Does this mean we shld quit and resign our fate. Live another day, Fight another day till we achieve what we want.
I contribute, i participate in the calls, i write to the reporters, i send faxes and emails to Senators/House Reps, Appear in Newspaper & Radio interviews and most of all Spare a Prayer to God to improve my situation. I believe once you use your AP for travel , you automatically comes EAD. If you are working for same employer with H1, then employer may have to inform uscis above status change (no big deal . i don't know if all employers are doing that) i don't think you can transfer your H1 after travelling on your AP. If you want to be in H1 status again all you have to do is leave country , get H1 stamped if expired and come back again. You will be in H1 status.

But aren't there sufficient applications received in July-Aug 2007 to use up all the numbers ?!? That's the loophole in your analysis. As per official reports, I believe close to 300k applications were received in those two months for AOS, true ?!?

even after entering US on Advance Parole.
Followup questions:
1. Is the I-94 # on your New H1B Approval same as the I-94 which you got
when you entered US on Advance Parole?
2. I am sure that your Attorney might have mentioned that last manner of
Entry into US is "Paroled" when he filed for your H1B transfer.
Please confirm this.
3. Finally, did u get any RFE for your H1B Transfer?
