I saw there are 50 replied to this post. Looks like people are more interested in others problems than their own.
Its pity that MOST CRITICAL issue we are facing at present - AC21 Denial issue, is having only 77 mails but everyone is jumping gossipping. Come out of this and show a unity to real problems.
Grow up and don't escape from real problems. Its our problem and we need to fight to resolve it.

paskal, you are making up things here that that priorities are Eb1->Eb2->Eb3
Eb1->Eb2->Eb3 is correct only from education and experience for the Job point of view but not true from Quota point of view all get 33.33per year.
�The argument that Eb1 is preferred/priority above Eb2 and BE2 is preferred/priority over EB3 is absurd.
The regular yearly BE quota is distributed equally among all three categories that means equal priority for all groups. So then why they should not follow the same distribution for the overflow numbers also?
Said that all BE3 applicants who are eligible should port there PD to EB2, simple. When you know how the system works try to adapt to it.�
We filed our CGs when we don�t know the system, we just trusted out attorneys. If we have to do this CG stuff again most of us will do it differently.

Just spoke to an IO from TSC, she said its the Filing date ( receiving date ) is what the processing time is based on

Note that the site tells you to contact them if your "receipt notice date" is prior to the published date, and you are still waiting. What is "receipt notice date"?

this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.
I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.
I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.
So don't judge others just because you have been lucky enough to maintain your status...

wow...she screwed us royally..on face she said she is going to approve our petition as it every thing and also PD is CURRENT..Now she sent a letter saying my PD is not current and adding insult to an injury she sent a link to the DOS bulletin which says I am current.

You can send Pay Pal contributions to any E-mail on earth, including info AT Immigrationvoice.org. It goes to the E-mail id as eCheck.
Only requirement is that the recepient (human) of the E-mail should collect the amount from PayPal. Not sure how this happens, I haven't received any money from PayPal ( or other means for that matter :D)
The E-mail id I gave earlier is IV merchant E-mail id @ PayPal. It would've made the transfer automated (I hope!)
Since there seems to be some apprehensions about revealing it (isn't it just an E-mail id?!), I have blanked out my old post.

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. Probably he explained in a much better way than i' d have explained. Spent 7 years on H1B, caught up in retrogression. I specialize in what is called as Rational Unified Process,train and mentor the application development teams.I've worked for a telecom company (one of the top 3 in USA), got laid off, started the journey again. Presently working for another frontline Financial Services company in the world. Recently, some of my work (with my permission) was included as a practical example for students in an university in St.Louis. however, i was not allowed to teach because of my legal status and constraints of H1B.
Even though it's painful to me, it's much more loss to the students who otherwise would have learned something valuable and make a difference in their careers
As a matter of fact, one of my colleague also applied in the same day, same attorney, same EB3, working for the same telecom company with exactly same designation but applied from Missouri, where as mine was applied in Kansas. He got his green card inspite of the layoffs, where my LC was not approved till today. (in 2002, some cases filed in MO were approved much quicker compared to Kansas) A classical example of how there is no justice &the current system is broken

I have legally asked this country and USCIS for Permanent Residency (PR). My request for PR is not based on the premise that my parents/relatives live here and are citizens in this country. I am not even asking for Permanent Residency because of the country I come from. I am asking for Permanent Residency based entirely on my educational qualifications, professional expertise and the demonstrated contributions I have made to businesses and the American way of Life.
I have also been accepted as an Instructor at a reputed University in California where I will be teaching in my area of expertise. This clearly helps the American society and Industry.
When I moved to the US, I believed America is all about meritocracy. Work hard, prove your worth and you get what you truly deserve. I feel six years is enough time to prove your worth to get a Permanent Residency.
My tax returns, my legal Status documents, my contributions to this economy etc will prove it. What is really disconcerting is the fact that, now I have to continue to wait for I don't know how many more years for USCIS to even look at my credentials, let alone give me an up or down decision. Mind you this wait is not because of any delays attributable to me.
Is this fair ?
If you think you don't need me, at least tell me, in a reasonable period of time. Please do not make me wait indefinitely.

I am a MS candidate and planning to start my OPT from October '07 and apply for H1 the coming April....I should be graduating by the year end.
