I am not able to start and feel that there is already hidden membership is there. Is there any thuth in this feeling? How does IV is working in terms of access rights?
IV is already not member friendly. With 25,000 members, raising 30,000 is getting so difficult. Why so? I once posed the question and moderators conveniently deleted it.

if "members" are willing to make this their organization their own- if there is to be this sense of involvement and ownership, then we will succeed. if not, if the attitude for the most is going to be "why should i" and "nope i am not contributing" and "how dare you ask" and "i have free speech" and "why doesn't iv do xyz for me" and "why should logiclife use this and that tenor" and "why did abc say def to me" and "i demand respect" and the best "these are my 2c but don't ask me to lift a finger to do this- iv should do this" then forget it. won't happen. because that IV you are imagining doing wonders and making miracles is YOU.
let me take this opportunity to thank everyone that participated in the fund drive, joined state chapters, met lawmakers, took initiatives to start state groups, ran the funding threads and contributed in any other way.

What pissed people off, was your tone and disgust at the poor fellow and his qualifications, especially when you know little about his ability to carry out his job, or his background. In school, or on line -- he earned those degrees. Maybe he didn't have the financial resources to attend the best schools (I don�t know what is IGNOU). His employer has retained him, so perhaps he is good at what he does. He left his home, his family and traveled to some foreign shore to earn a living, not rob a bank. Show some respect. Many of us are waiting to file I485. Think about them who have filed and are stuck in namecheck for 2 years plus or waiting for visa numbers to get current- they are renewing their EAD every few months (and guess what, they are paying extra money).

All H1 filings which now pay a fee of $1500 or $750 will be asked to pay $10000 or $5000.....It does not apply to the H1 exempt institutions....

H1baspirant, you should be fine..my brother was F1-OPT-H1. His interview was in ND and kept his pp. he got his pp back with stamp withiin 9 calendar days..i think you PIMS should be done. In mumbai they are asking candidates to drop pp and etc once PIMS is verified. So maybe your case is same..

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
If you have only 14k then that is all that they can claim from you. In extreme cases they can consider put a lien against your future pay (for eg: 50% of future pay going to pay for the damages).
But don't worry so much!!! Why you will ask? here are the reasons.
Firstly, it matter who is suing you. Are the lawyers representing the insurance companies of the victims or are the lawyer retained by the victims directly.
If the lawyers are retained by the victims directly, the victim has to pay the lawyer to fight this case. The lawyer will only fight if there is way they can get you to pay the fees. The fees for such a lawsuit will far exceed 14K!!! So what you might want to do is request a lawyer to write a letter on your behalf to the lawyers of the victims and request them to settle out of court. for may 10K or else threaten that you will leave the country and they will recieve nothing!!. Ofcourse you don't have to leave the country you are using this as a barganing chip. Move the 14k to india in your parents or sibling's name. that way when they do an asset check nothing shows up.
From your posts you are sounding very stressed!! don't be relax you don't have to give up your GC. You have get a lawyer to help you out and pre-empt this before it goes to trial. Even after it goes to trial get a lawyer and fight for this (provided it does not cost you more than 14K). If you or your wife or kids are in university, most universities have laywers who will give free advice to students. You can also choose to pay between $100-$500 for consulation with other lawyers (remember the lawyers you are going to consult also want to make money so they will push you to retain them and some of them will scare you with the most unlikely scenarios. Filter this out by talking to 4-5 different lawyers).
G'luck. this is not the end of the world and frivilous lawsuits in the US are more common than legitimate lawsuits. This is not worth your sleep! Fight for this and don't think about giving up your GC for this!

In the EB base, only 1 GC is counted for all family members. How can it count more than one if it is a derivative of an employment visa? It might count against the Family base even though primary applicant is EB-based. Not the other way around.

Congress is putting so much of restrictions on H1B and reducing Green Card for employment based.
I think this is the time to negotiate with Businesses and try to release a joint statement that
"Business will transfer the jobs to India/China along with people who are currently on H1B and struck in Green Card backlog. This may force business to close some divisions in the US and eventually US citizens will loose job."

It is believed that there are numerous industry groups as well as individual companies that may be pursuing litigation on this matter. I appreciate your enthusiasm. IV has directed all its members in the past to do what and when? They have also established a webfax mechanism and also asked IV members to contact the senators / congressmen. They have gone into the level of seperating statewise members and asking only certain state members to contact.
Once again I appreciate your thoughts. But the members should follow one direction and it should come from core IV. Do not do certain things without the consent from IV as it may back fire.

Man/Woman, I see so much energy here or could be just shouting. It would be in the best interest to use the energy to contact respective congressman/woman/senator of their area, ask them / request them to bring/pass legislation like SKIL and PACE. Tell them why this bill is needed. Tell them your problem. If everyone of us call congressman and woman and follow up with them on the progress that would be great. Am I doing it? Yep..Not joking IV members are involved.
IV guys can you develop questionnaire which we should ask the operator. What I did is I asked to operator to connect me someone who can help me in bringing immigration legislation. That is how I approached the operator. IV associates what I am getting at is how should people reach right person? As IV people have interacted with many senator office they have better idea what are different staffer there and how they are addressed, and how to reach them.
Let me know what are people thought? I think instead of wasting time, lets get to work. Help yourself by calling senator/congressman/woman. And this is oppurtune time.

If there is any such program to contact any senator, it will be announced by IV core through State chapters network. That's the purpose State Chapters were created! Right now no such action plans exist!
A sincere request to anyone, DO NOT create your own 'Action Items' on Legislative actions. Reason being, legislative matters are delicate and need careful handling. If handled without a holistic perspective and professional advice - which only IV core can provide - may backfire and harm IV cause, instead of helping it!
Regarding H1B
If the system is broken, it should be the responsibility of DoL and government to fix it. Laws on book should be enforced first before introducing new laws. Raising the fees to astronomical levels will kill the program instead of reforming it. Real fix to H1B issues is increasing the number of green cards and provide a level playing field. Wish there was work on permanent fixes to the system instead of efforts to kill it.
