    Can we propose a bill which would give us - the honest, sincere, law abiding aliens - a time bound path to Green Card and Citizenship?

    Political parties only talk and seem to be interested in giving illegals a time bound path to citizenship? They even introduced a "Dream Act" in favour their children. Why should we / our children be sidelined?

    Can we request for a bill which would:

    1.Grant GC to all EB 2 / 3 class pimary applicants who have completed 8 years of continuous stay in the USA without any criminal record.

    2. Provide Citizeship to all EB primary applicants who have completed 12 years of continuous stay without any criminal record

    Note:

    When the primary applicant is issued a GC / Citizenship, the dependents (spouse and kids) should get the same benefit.

    The current system is designed to favour ONLY the employers and the law firms, not the humble, hard working EB class slave who toils.

    Hi All,

    My cheques got encashed & based yesterday.

    Application filied on : July 2
    Service Center : NSC
    I-140 approved on Jun 2006 from TSC
    LUD of I-140 : 07/28/2007
    Recp.No starts as : "SRCxxxxxxxx"

    so looks like though I filied the application at NSC based on the working location it got transferred to TSC as my I-140 has been approved by TSC.

    For some reason this does not sound right. If there was spillover of 20000+ visas (of course, this was an assumption), have we seen that many approvals? To me the approvals seemed normal, not much.

    Hope this info is incorrect.

    Can we have some tieup with some flower delivering company? Like, for each floer ordered by IV member, some percentage will be donated to IV. But the point is every one from here will order the flowers through them. Any thoughts?

    That is a nice thought, if you know anybody that will donate the money to IV please let us know. (Pun intented). :D

    My wife's case may or may not be fine. She came on H4 and got her H1 in 2004 but got a project only in the middle of 2005 and the company started paying her only once she was on project. But thats fine. If her 485 gets rejected (although the company not paying her is not really her fault), we'll just pack our bags :) Also, her I-140 is still pending.

    Since you're a beneficiary of you're wife's AOS, you're in "pending status of authorized stay". Therefore you *are* authorized to stay here as of that day until a decision on the 485 is made (the unlawful stay clock stops ticking). If you get rejected on your H1 extension, you can still stay in the country and possibly work on the EAD (a derivative benefit of the 485). If you think your wife's 485 is airtight, and there's a problem later you can use the 245(k) provision since you were in unlawful stay for less than 180 days.

    Very well said. I have been on IV and actively participated in a lot of campaigns and events and interacted with a lot of people from different walks of life, different nationalities, different situations etc ... WHat I have noticed is, everyone has their own opinion and stay entitled to their opinion. Everyone wants to be judgemental through their opinion.

    Now, lets all for a moment - step out of our "legal immigrant" shoes and step into the shoes of someone who has to decide what to do? As a decision maker, what will you do? Everyone has their own opinion to which they are entitled and thats whats happening.

    Now, ocne again - step out of your legal immigrant shoes, and say, for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"

    If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop lifting .....

    If you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?

    All you have to do is to come out of "the hate and hard" thinking and try to look at things in "rational and meaningful way"

    Hate no one for what they are or how they are. Try to see if you can help. Just help.

    I have been living in US for close to 10 years now and though I am proud of fellow Indian community and their achievements, I have also noticed how the community is divided and oponionated. Forming so many sub groups, promoting caste feelings, fighting each other, trying to piut down other fellow community members, lack of unity and what not ....

    If everyone in this world want to be considerate and help - then there will certainly be a day when we can see a world without poverty, wars and all the issues we are having today.

    What I and the majority of people in this forum do is their best to make sure they dont loose their status. If on the other hand it happens I would return to India and consider all options to reverse it. What I and majority of people here wouldnt do is stay here illegally. Loosing you status is not a crime for which you are shackled and put in a detention center. A repeated pattern of violating the law is.

    This analogy does not apply to anyone on this forum as "Legal immigrants" plan for contingencies. Even if it happens I would ask for food as a favor from some one rather than break into their house and demand it as a right!

    We are talking about a 35 year old woman with a repeated pattern of ignoring the law, not about a hungry child. This is a completely false comparision.

    I dont hate them, i just think what they do is wrong and they shouldn't be rewarded for it. If an illegal comes asking for food, I am pretty sure every one will be happy to feed him. But if breaks into my house and starts raiding my refrigrator, he better watch out.

    You are a senior member of IV and I know IV has concluded that any chance of meaningful immigration reform goes hand in hand with that of the illegals. I understand that, and have made contributions as and when i could to IV. But that still doesnt make illegal immigration "right".

    Im going to India on vacation for 2 months. I could not get my passport corrected in US as I need to travel to India in a week.
    What is the procedure in India for getting this corrected ? Would i need the Newspaper clipping from Local US newspaper here..? I was not sure of this. Please help me.

    The only one-time $50 contribution option I saw was the one that said "$50 and subscribe for one month", I assume that was a one time $50 option.

    Not that I don't want to contribute on a recurrent basis, but I already have an indefinite $50 recurring option set up since 2007.

    Hello guys,
    Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.

    We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
    She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
    I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child’s safety every day.

    Thunderbold, Sorry for your situation. Here is my observation/suggestion.

    Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?

    You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.

    This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.

    This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?

    What are we going to do with that money man? This is nothing but a greediness.

    Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.

    Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?

    Hello All,
    i concur with the aspect of filling a lawsuit, as it will create more visibility and put more pressure on congress. As it is congress is under the gun for failing to act on a lot of bills. Even though if it does not create instant results, it will definitely lead to some type of change in coming months. I am sure if we all pitch in 50$ each, we can accumulate good amount of money. Also we can use Murthy Law firm to file a lawsuit. Lets not forget the amount of visibility Murthy law firm is getting from IV. If there is a law suite filed through them, then they also get to share the limelight.

    The point here is, we can get a discounted price on the service, also Murthy law firm is aware of our situation. Administrator what do you think?


    All EB3 guys, stop complaining about EB2-EB3, it is about EB community. IF EB2 get some direct benefit, then it will be rolled down to EB3 as well. Please let us not discuss issues which separate us. Right now we should focus on unity and creating a mass number of high skilled workers who can SHOW up on rally's.

    Sorry but I don't agree with your point that if EB2 benefits today EB3 would benefit tomorrow. It looks plain and simple but it's not so in reality. Unless all EB2 categories become current and EB3 ROW get the overflow and become current, EB3 I (or China or Mexico) is not going to be benefitted from EB2 getting a VISA! You are basically saying to EB3 filers to wait for another 10 years so that the EB2 queue may reduce so that EB3 queue would start moving. That's not a practical solution.

    I think once there is an overflow (from EB1), then it should:

    1. go to the category that's retrogressed more or
    2. split the overflow among retrogressed categories and
    3. go to EB2 if both EB2 and EB3 have the same cut off date.

    Does US need more EB2 (than EB3) or need them sooner (than EB3)? If they need more EB2, then EB2 can get more numbers (but the restriction should happen at H1/L1 level). If they need them sooner, then they can be on a fast track. But by approving a EB3 or EB2 I140, the Govt. is saying that they need that particular applicant. A vast difference between these two categories at the last queue (485) does not make sense.

    It is insane to ask a EB3 I 2001 filer to wait forever just because he filed under EB3 and grant a VISA to EB2 2004 filer! It is not different from granting a VISA to a EB3 2007 ROW filer and making EB3 I 2001 wait. EB2 is taking all the overflow which, in my view, is not correct. EB2 is benefitting at the cost of EB3 I (China and Mexico). EB3 ROW is benefitting at the cost of EB3 I (China and Mexico). Just my opinion.

    I grow different kind in my backyard. It all depends on the size of your backyard and which zone you live in states. I live in virginia. By this August end /september first week summer crop will end. I grow tomatoes(30 plants), Mint, snake guard, water melons (15 plants), cantaloupes(10 plants), carrots, okra, spinach , chillis. Its fun and hard work too. You need to dig the soil, mix with top soil or garden soil and cultivate it. Every week fertilize it. This is my first year gardening. I have around 3000 square ft of back yard. i do not know what to do with that. I cannot maintain Lawn in back yard. So I decided to grow vegetables.
    I am eagerly waiting for my fall garden..I am planning to grow tulips,beets,cilantro,carrots,potato,peas etc., If I can get same space for garden In India and work place just 3 miles from home , I can happily go back to India.

    Thank You IV for providing us with this platform to get our voices heard where it matters the most. Go IV!


    The phenomenal experience of actually doing something positive to solve our problems is - but I am just acknowledging the great enthusiasm that was vibrating with our members - they realized the gravity of the situation, the opportunity that was within their grasp and wanted to make the best use of it. Hats off to you guys!!

    IV realizes that our strength lies within our members and their dedication - both in terms of participation and funding. And if there is one thing that almost every single participant took home from the event is that - we still have a long way to go and we need far more support and participation. .

    Thank You needhelp!, Devang, StarSun for summarizing the DC Experience. Each one of us that went to DC came back with a more positive outlook, the satisfaction of doing something good. I will write in detail my personal experience, but in a nutshell- The camaraderie, the enthusiasm and the tireless effort that some members put in is just commendable.

    Thats True, I see that too that people doesnot seems to be enthusiastic, may be because of the reason that many members have left after getting their GC.
    and are not intersted in this effort any more.
