Once we cross Aug 17, IV should seriously think of how to resolve the backlogs of I-485 and also should think of new people who need to file I-485.

Yes, I'm the primary app. Both of us went for the inetrview..., we can do that... the questions were regarding both of us, like both of our employment letters, paystubs, W2s, since both of us are working, and also EAD, H1/H4 797s, etc of both us.

I came to the conclusion just based on section INA 202 (a) (5) (A). Nothing more nothing less. You came to funny conclusion of "quaterly basis".

With all this available; not one lawyer has decided to sue department of state or uscis over this. Why is that? Maybe what they are saying is correct and you are reading into it what you want to read into it.
Any time someone gets around to explaining the system; they are automatically branded anti-indian. Funny but everyone I know through immigration is Indian. Therefore, whenever someone brands me anti indian or even comes close to it; I get a very good chuckle out of it and so do the people who know me that frequent these boards and immigration.com

I had been on the record that maybe people shouldn't get too worked up about this. The louder one becomes the more scrutiny starts happening. Once the scrutiny gets wratched up a few notches; are you ready to counter it.
What is this scrutiny that you may ask?
Newspaper in Maine did very thorough investigation of companies who sponsored labors through Maine. It was very hard hitting whcih asked for comments from Department of labor and USCIS. Both are investigating it. Essentially it said that companies rented out a cube and filed 60 labors and 100 h-1b's when their real offices were in other states that were taking a long time to get labors approved.
Backlog reduction centers are challenging companies to prove that their headquarters were where they said they were? They are questioning whether there is a permanent job. Companies are not responding and letting the labors go. Don't you think department of labor will start going into the approved labors and start scrutinizing them.
California service center denied many cases for two companies that I know of who had revenues of over $20 million. Reason for denial was that they are temp. agency and no permanent job. No permanent job; no I-140 approval. Companies have gotten a good dose of H-1b RFE's from california service center regarding this. Many have gotten the h-1b's denied because they can't even substantitate they have a job for the person. If they don't have a temp. job then how can they have a permanent job. Chennai consulate is giving very difficult time to staffing/consulates. It has gotten so bad that back in early december; consulates in india said if you are good in english you can go to ther consulaes in india. Guess what? Chennai it only takes two days to get an interview now because everyone refuses to go there. Just a matter of time before new delhi and mumbai catch up. if consulates are refusing visa stamping for temp. jobs what do you think will happen when they start ratcheting it up a notch to the permanent jobs.
Main reason they haven't gotten into the permanent jobs yet is because nurses which are really in demand also get greencards through staffing companies and are outsourced. Since, nurses are needed; uscis doesn't want to give a hard time to the staffing agencies; therefore, they don't want to be accused of double standards. We will see how this will change if at all as retrogression and increasing visas and studies are performed how people are getting greencards come to light.
btw; I have been on record that as long as country cap of 7% is maintained; it would have disasterous consequences for India/China to allow 485 filing without priority date. Since the 7% cap applies then that means someone who enters usa today from ROW and files an eb2 labor will get priority over you. Anyone can file a 485 as long as they have a labor, 140 and they are in non immigrant status. I know of three people through other forum who were from ROW; came on visitor visa found someone to file perm labor get approved in a couple of weeks and then go straight to 140/485. Since they can file 485 right away they get precedence over india/china. Anyone on visitor visa would be eligible. This would number in the millions. It would be quite possible that there would be never ending retrogression for India and China.

I guess My interview didn't go as expected.
20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in

I had the first-hand opportunity to meet and see IV core members working for our cause. Really, it gives you the chill that thinking its the same GC everyone on this forum wants but the dedication with which they are approaching is amazing. There is no point talking about what we "could have done" after the congress session is over and god forbid, our bill doesn't pass through. 2008 is all about elections and the citizens, not too much of immigration will come to forefront, so please think.....

I think the IO just say anything that comes into their mind because they know nobody's there to hold them accountable during the interview process. Thats why I think one should take an attorney along during the interview process if they think their case maybe little complicated. At least the attorney can step in when it comes to the IOs denying your application improperly. Does anyone think this is a good idea to be on safer side?

Most people think law suit is a bad thing, but that is not right. In a democratic country law suit is the right way to deal with things. We are legal immigrants, we have all the rights to file a law suit, but with full support of IV.
People have already filed a law suit on the same day the President signed the bill! (yesterday, the wire tapping bill...)
By filing a law suit, all we are trying to do is to fix the laws which are not working. Basically, we are doing the right thing. Not only us, but future Legal immigrants will be benefitted, they don't have to go thru what we had to...
Here are the things that needs to be fixed...
1. Country quota
2. Recapturing visas..
3. 3 year EAD/AP
4. End the endless wait ( Proposing a new law ;))
What is "End the endless wait" ?
EAD is a very good example, If 90 days have passed after filing EAD, you have the option to go to a local USCIS office and get a temp one. We should have a similar option for all the peper work. For example, each and every stage in green card process should have a a day count for processing. Like name check should be completed in 180 days.
Basically, when we receive any receipt notice, it should have a statement which reads "We have received your application and we will take action within 180 days. If we fail to act by MM-DD-YYYY, Please go to the nearest USCIS for approval.."
Sounds little ambitious ?? well, we are not asking for too much, just a day count. Lets say if the whole Green card process takes 3 years or 10 years based on the day count for each stage, people can decide whether they want to immigrate to USA with a clear idea that it will take x days to become a permanent resident ( like how it works in all other countries except USA)
Even a person jailed gets to know how long he is going to spend his time behind bars, but we do not know when we will be free from this immigration mess!

Long time back when the british ruled India a lot of our ancestors joined their ranks and spit on fellow Indians. They were not realizing that actually the british were using them to rule effectively. That same trait has remained ever since. This is one of the greatest sin of the Indian and also many other third world cultures. They act on opportunistic thought patterns trying to gain favor whenever the opportunity arises even if it meant spitting on their own relatives. Sympathy, compasssion, honesty and integrity is often forgotten and/or purposefully suppressed for apeasement of the rulers. The feeling that you are being ruled and not in control of your own life is what really promotes such self righteous thoughts.
If you analyze this situation you will realize that there is a debate going among american citizens regarding legalizing the 11 million folks here and those favoring are in majority now. Long time back when the british ruled India a lot of our ancestors joined their ranks and spit on fellow Indians. They were not realizing that actually the british were using them to rule effectively. That same trait has remained ever since. This is one of the greatest sin of the Indian and also many other third world cultures. They act on opportunistic thought patterns trying to gain favor whenever the opportunity arises even if it meant spitting on their own relatives. Sympathy, compasssion, honesty and integrity is often forgotten and/or purposefully suppressed for apeasement of the rulers. The feeling that you are being ruled and not in control of your own life is what really promotes such self righteous thoughts.
If you analyze this situation you will realize that there is a debate going among american citizens regarding legalizing the 11 million folks here and those favoring are in majority now. Who can sue them? A non-US citizen?

A US Citizen can ask for a PIL??
I believe that even non-citizens can sue USCIS through an attorney...
