I just received a letter from the person who took my AOS interview
The letter reads like this,
The Priority date for your classification is not current at this time. Your case meets the requirements for abeyance until a visa number is available for your priority date. Please refrain from making status inquiries until 90 days after your priority date is available. To view priority dates go to: http://travel.state.gov/visa/frvi/bulletin/bulletin_1360.html
wow...she screwed us royally..on face she said she is going to approve our petition as it every thing and also PD is CURRENT..Now she sent a letter saying my PD is not current and adding insult to an injury she sent a link to the DOS bulletin which says I am current.
Only you can Do USCIS..Long live.

Just like with individuals, we tend to place trust on organizations and instituitions based on their past behaviors / actions. It's obvious we have very little trust on USCIS.
I think there is some misunderstanding on the memo bein discussed.
I'm still betting USCIS has a (reasonably accurate--- give or take a thousand) tally of pending India / China EB2 I-485s that match the available GC visa numbers which have to be used up before Sep 30th. All they have to do is assign visa numbers before September 30th. It is quite possible for them to process the applications and assign the visa numbers at the end. Most likely approvals will come well into October.
Well, that's the way U and I would do it, so no visa numbers are wasted. It remains to be seen if the UscIs has more cooks than just U and I! ;-)

As everyone is aware of the FOIA letters we have received from USCIS. We requested everyone to fax/email us the USCIS letter.
Here is an update on IV plans and what we know till now:
On Friday, during the discussions with USCIS, we came to know that that there is a backlog of FOIA requests and currently they are clearing FOIA requests they received in 2007. We also know from the letter that the report wll not have 'country of chargeability' info. This is a critical info that we ought to have. Even after paying 5K to USCIS, over one year wait time to get the FOIA request completed will be unacceptable to the community.
In light of these developments we have explored other options to get this data and use the copies of replies we get as an example how badly we need this data to get accurate picture of the size and breakdown of the current backlog, so that we can all know how long we need to wait in the current system, if nothing changes. We would also ideally like such data to be always available and updated for public periodically.
Our first option is that we put in effort to get this data without having to pay $5K to USCIS. We will also try to get the data much sooner rather than all of us wait for more than a year.This could be possible via advocacy effort and our initial discussions on this subject have been promising. We will pursue this and if we do not make much progress until the deadline then we may pay 5K and still pursue the advocacy option to get the data faster. Thus we need more than 5K to proceed with these parallel options. The advocacy effort will also be an ongoing task beyond the first month. Thus we request members to sign up for recurring payment option to support this initiative and any other initiative we undertake for the community.
We have added a paypal module on the top of each page with a target amount. Members can use this fresh tool added to IV website to contribute. We prefer if members contributing to the effort on recurring monthly basis for a long term support of IV efforts. All members who contribute through this system will also have access to special 'Contributor's Forum' on the IV website.

Visa number is only "assigned" after all kinds of review and background checks are done. This is by far the last step in the wayward journey.
In other words your LPR status is registered only when the visa number is received from DoS. So pre-assigning of visa numbers while review continuing in the background is simply not possible !
Bottom line is getting VISA number assigned to file when current, and let them complete review at later time, once File has VISA number then its ready to for approval.

Yes, you may end up blocking strive act, but what will happen then is all your jobs are going to start disappearing to eastern europe, China, India and any other place possible. I don't know if you work in high skilled labor market but if you do, I am sure you must have noticed the large number of engineers, doctors, architects who are immigrants and contributing to this society. Anyway, I think discussing this point with you is pointless.
Anyways, you are welcome on this forum. You can express your opinion as much as you want. I don't think we (or you for that matter) are going to gain anything by arguing online. We will have the rally and see what happens. I will do my duty(the rally) and leave the rest to God. Wish you all the best in your efforts. I hope whatever issues you have work out for you.
After hearing this, do you think our folks will sit quiet. We will do whatever it takes to makes sure that American jobs stays American.

1).I came to USA on L1-B in 2003 October and the I-94 was till september-2006.
2). Then i changed my Visa to H1-B in 2005.
3). I was asking my employer to file for change of status from L-1 to H-1.
4). Those guys filed for a new H-1 and sent it to a consulate in India.
5). I was not aware of this and i thought i am legal till september the expiration date on my Visa.
6). Labor got cleared in July-2007.
7). Thought i would file for I-140 and I-485 together and found out that my I-94 was expired since September-2006.
What is the best course of action here to remedy my situation??
Any advice or details of a great Immigration lawyer who dealth with such cases before would be of great help.

and see from which IP Address, GC status is sending those messages. Find out the location from where he is sending messages. Dont spread false news.
